Terms of Service

These Terms of Service govern the engagement and use of the Web Design & Development, consulting, e-commerce, ranking and digital marketing services offered by Carlos Viteri, part of Grupo Empresarial Linkeia, with operations in Guayaquil (Ecuador) and Miami (United States). By requesting or contracting any of our services, you accept these terms in full.

1. Provider and jurisdiction

The party responsible for the services is Carlos Viteri, a web development and e-commerce consultant. The contractual relationship is governed by the laws of the Republic of Ecuador, and any dispute shall be resolved before the competent courts of the city of Guayaquil. 2. Scope of services

We offer custom Web Design & Development, online stores, optimization, SEO ranking, digital marketing and technology solutions. The specific scope of each project —deliverables, sections, timelines and investment— is formalized through a personalized proposal or contract accepted by the client before work begins.

3. Ranking and SEO

Ranking on search engines and AI engines depends on multiple external variables that are not entirely under our control. We apply SEO and indexing best practices, but we do not guarantee specific positions, traffic volumes or timeframes for results. The continuity of the strategy and the implementation of our recommendations are the client’s responsibility.

4. Web development and e-commerce projects

Every project is carried out according to the approved scope. Any change, additional section or functionality not initially contemplated may involve extra costs and an adjustment to the timeline. The client agrees to provide the necessary content, access credentials and approvals on time. Delivery timelines are estimates; delays justified by the complexity of the project or by factors attributable to the client are not considered a breach.

5. Third-party integrations and platforms

Payment gateways, logistics services, CRM, ERP, hosting and other external platforms operate under their own terms and conditions. We assume no responsibility for failures, interruptions or changes in such third-party services.

6. Payment terms

Starting the services requires a deposit; partial payment plans are accepted as agreed. Non-payment entitles us to immediately suspend the work. No refunds are issued for work already performed or in progress; in the event of early cancellation, charges will be billed up to the effective completion date.

7. Intellectual property

Final deliverables are transferred to the client once the agreed full payment has been completed. We reserve our methodologies, frameworks and the right to showcase the project in our portfolio, unless a confidentiality agreement prevents it.

8. Confidentiality and data

All information shared during the project is treated confidentially, an obligation that continues even after the relationship ends. Personal data is processed in accordance with the data protection regulations in force in Ecuador. See our Privacy Policy.

9. Limitation of liability

Our liability is limited to the amount actually paid for the corresponding project. We are not liable for indirect damages, loss of profits, loss of data or business opportunities arising from the use or inability to use the site or the services.

10. Force majeure

Events of force majeure or fortuitous events —such as internet failures, cyberattacks, third-party decisions or regulatory changes beyond our reasonable control— are excluded from liability.

11. Amendments

We may update these Terms of Service at any time. The version in force will always be the one published on this page. Continued use of our services implies acceptance of the updated version.
